Chemical Incident Prevention Measures: Historical Application Procedure

Historical reference — 2013 framework. The administrative procedure operated under the 2007 Law on Chemicals, Decrees 108/2008 and 26/2011, and Circular 20/2013/TT-BCT. It should not be used as a current filing checklist. Confirm the applicable law, competent authority and forms before preparing a new submission.

Submission and review

  1. The organization or individual submitted the application to the receiving and results-return unit of the provincial Department of Industry and Trade.
  2. Within four working days, the authority reviewed completeness and requested amendments where necessary.
  3. For a complete dossier, the authority inspected and assessed the prevention and response measures within the following 16 working days.
  4. The applicant received the confirmation or a written refusal explaining the reasons.

The 2013 procedure specified 20 working days in total, excluding time spent by the applicant supplementing or correcting the dossier. Applications could be delivered in person or by post during the authority’s Monday-to-Friday office hours.

Application documents

  • An application using the form in Appendix 8 of Circular 20/2013/TT-BCT.
  • Five copies of the chemical incident prevention and response measures, prepared according to Appendix 7.
  • One certified copy of the feasibility study, economic and technical report, or production and business plan.
  • Other supporting documents where relevant.

These documents formed one application dossier. The confirmation followed Appendix 10.

Who the historical procedure covered

The 2013 framework addressed facilities handling hazardous chemicals below the applicable plan thresholds, together with relevant chemicals for which no threshold was specified. The appropriate type of safety document depended on the chemicals, quantities and activities at the facility.
