Environmental Protection Commitments and Current Environmental Records

“Environmental protection commitment” refers to a document under Vietnam's former legal framework. Businesses seeking this service should identify the procedure that applies to their current project or facility before reusing an older form.

1. Identify the appropriate environmental documentation

The environmental framework uses mechanisms such as environmental impact assessment, environmental permits and environmental registration, depending on the relevant category. The same procedure does not apply to every facility. Older records provide input for reviewing legal status and project changes.

2. Information to prepare

• Location, scale, capacity, products and project stage.
• Technology, raw materials, fuels and water requirements.
• Sources of wastewater, air emissions, solid waste, hazardous waste and noise.
• Treatment facilities, incident prevention measures and available monitoring results.
• Previously confirmed, approved or permitted environmental records, and subsequent changes.

3. ITVC's support process

1. Survey current conditions and collect project and surrounding-area information.
2. Review older records, identify pollution sources and check applicable requirements.
3. Propose appropriate waste collection and treatment, impact reduction and incident prevention measures.
4. Agree the required documentation, service scope and missing information.
5. Assist with preparing and completing records and clarifications within the agreed scope.

The competent authority handles receipt, appraisal or permitting under the relevant procedure. Timing and fees depend on the actual records.

4. Expansion and operational changes

Review the documentation when scale, capacity, technology, materials or waste streams change. An older commitment should not be assumed to cover all new activities; equally, not every change requires the same procedure.
