What is a record of commitment to protecting the environment?

·         This is a legal dossier binding responsibility between the enterprise to the Department - Ministry - Department of Environment in particular and the world in general and is a process of analyzing, evaluating and forecasting the environmental impacts of the project in the implementation and operation phase of the project. Thereby proposing appropriate solutions to protect the environment in each stage of operation as well as construction of works.

Why does a company make an environmental commitment record?

·         The commitment to protect the environment is to require production and business establishments to implement what your company has committed to on the commitment to protect the environment, in order to minimize adverse impacts on the environment in the process of operation, design, construction,  production...

The written regulations must make a commitment to protect the environment:

According to Article 29 of Decree No. 29/2011/ND-CP, the subjects need to make commitments to protect the environment including:

Investment projects of nature, scale and capacity not in the list or below the prescribed level of the list in Appendix II of Decree No. 29/2011/ND-CP:

a) The establishment does not have one of the following documents: Certificate of registration meeting environmental standards, certificate of registration of environmental protection commitment, written notice of acceptance of registration of environmental protection commitment, certificate of registration of environmental protection scheme, certificate of registration of environmental protection scheme

b) The establishment has one of the following documents: Certificate of registration meeting environmental standards, certificate of registration of environmental protection commitment, written notice of acceptance of registration of environmental protection commitment, when renovating, expanding or raising capacity of the subject subject to making a registration document meeting environmental standards,  a commitment to additional environmental protection (before the effective date of Decree No. 29/2011/ND-CP) or subject to repeat the commitment to environmental protection (as prescribed in Decree No. 29/2011/ND-CP) but there is no certificate of registration meeting environmental standards or a certificate of additional environmental protection commitment or written information report on the acceptance of registration of environmental protection commitments that have now completed the renovation, expansion and capacity raising

c) The establishment that has obtained a certificate of registration of the environmental protection project, when renovating, expanding or raising capacity, is subject to a written commitment on additional environmental protection (before the effective date of Decree No. 29/2011/ND-CP) or is subject to repeating the commitment on environmental protection (as prescribed in Decree No. 29/2011/ND-CP) but not have a certificate of commitment to additional environmental protection or written notice of acceptance of registration of the commitment to protect the environment that has now completed the renovation, expansion, capacity raising

d) The establishment has a certificate of registration of a simple environmental protection project, when renovating, expanding or raising capacity, it is subject to a commitment to protect the environment but there is no written notice of acceptance of registration of environmental protection commitment that has now completed the renovation,  expanding, raising capacity

dd) The facility has started construction and is in the preparation stage (ground preparation), has completed the preparation stage and is in the construction phase but has not yet issued a written notice of acceptance of the registration of the environmental protection commitment or the certificate of registration of the simple environmental protection project.

The process of making a commitment to protect the environment

·         Survey and collect data on the project size.

·         Survey and collect data on the current state of the environment around the project area.

·         Survey of natural conditions and socio-economic conditions related to the operation of the project.

·         Identify the sources of pollution of the project such as: emissions, wastewater, solid waste, noise, identify the types of waste generated during the operation of the project.

·         Assess the impact of pollution sources on resource and environmental factors.

·         List and evaluate the overall solutions and items of environmental protection works to be implemented.

·         Develop measures to reduce pollution and prevent environmental incidents for outstanding items.

·         Proposing plans for wastewater treatment, emissions, solid waste collection and treatment plans from the project's operation.

·         Develop an environmental management and monitoring program.

·         Drafting dispatches and dossiers of request for approval of environmental protection schemes.

·         Appraise and decide on approval of the scheme.
