Consultants applying for discharge permits and extension of discharges

Enterprises that come into operation need to have environmental protection records in accordance with the law to ensure legality and transparency in the operation process. At the same time, in order for me to create a sustainable development foundation and for the common goal of protecting the environment, businesses must meet the requirements of the law on environmental protection - One of the important and necessary environmental records is the discharge permit.

1. Discharge permit

The discharge permit into the water source shall be issued by the Department of Water Resources Management under the Ministry of Natural Resources and Environment (responsible for receiving and managing the dossiers and permits issued by the Ministry of Natural Resources and Environment), and the Department of Natural Resources and Environment (responsible for receiving and managing the license dossier issued by the Provincial People's Committee),  for the purpose of managing the discharge of wastewater into the irrigation system of organizations and individuals carrying out production and business activities (this license regulates the flow of wastewater, the quality of wastewater after treatment, the source of receiving wastewater, the location of discharge into the water source).

The discharge permit is a form of transfer of the treatment from the owner of the waste source to the place of receiving the treatment, favorable for enterprises that do not have direct treatment conditions. The discharge permit will provide local authorities with the source of discharge, the quality of the discharge water and the source of reception as a basis for inspection, comparison and easier control.

2. Subjects must make discharge permits

The subjects who must apply for discharge permits are: enterprises producing, trading in services, industrial parks, residential areas, urban areas, hospitals, hotels, factories, factories,... discharge wastewater into water sources (rivers, streams, canals, ditches, canals...). These objects have wastewater treatment system and wastewater quality reach QCVN Column A before discharging into the receiving source.

Legal grounds:

- Water Resources Law promulgated in 2012

- Decree No. 149/2004/ND-CP dated July 27, 2004 of the Government regulating the licensing of exploration, exploitation, use of water resources, discharge of wastewater into water sources.

- Decree No. 34/2005/ND-CP dated March 17, 2005 of the Government on sanctioning administrative violations in the field of water resources.

- Circular No. 02/2005/TT-BTNMT dated June 24, 2005 of the Ministry of Natural Resources and Environment guiding the implementation of decree No. 149/2004/ND-CP dated July 27, 2004 of the Government regulating the licensing of exploration, exploitation, use of water resources, discharge of wastewater into water sources.

- Circular No. 05/2005/TT-BTNMT dated July 22, 2005 of the Ministry of Natural Resources and Environment guiding the implementation of the Government's Decree No. 34/2005/ND-CP dated March 17, 2005 on sanctioning administrative violations in the field of water resources.

The licensing authority will depend on the discharge water flow for one day and night:

- Discharge from 10-20 m3/day will be licensed by the District Department of Natural Resources and Environment (district).

- Discharge from 20 m3/day to less than 5000 m3 will be licensed by the Department of Natural Resources and Environment

- Discharge of 5000 m3/day or more will be licensed by the Ministry of Natural Resources and Environment

3. Application for discharge permit

- Application for license (form No. 01/XNT of Circular No. 02/2005/TT-BTNMT).

- Results of analysis of the quality of water sources where wastewater is received in accordance with the State's regulations at the time of applying for permits.

- Regulations on sanitary protection zones (if any) prescribed by competent agencies at the place where wastewater is expected to be discharged.

- The project of discharging wastewater into the water source, enclosed with the operation of the wastewater treatment system; in case of discharging wastewater into the water source, there must be a report on the status of wastewater discharge, accompanied by the results of the analysis of the wastewater composition and the certificate of payment of environmental protection fee for wastewater. (Form No. 02/XNT of Circular No. 02/2005/TT-BTNMT).

- Map of the location of the wastewater discharge area into the water source at the rate of 1/10,000

- The environmental impact assessment report (EIA) has been approved by the competent authority in case the environmental impact assessment must be assessed in accordance with law.

- Certified copies, or valid papers on land use rights as prescribed by the Land Law at the place where wastewater discharge works are located. In case the land where the wastewater discharge works are located is not under the land use rights of organizations and individuals applying for permission, there must be a written agreement for land use between organizations and individuals discharging wastewater and organizations and individuals that are entitled to use land, certified by competent people's committees.

4. The duration of the discharge permit.

- The duration of the permit to discharge wastewater into the water source shall not exceed ten (10) years and is considered for extension but the extension period shall not exceed five (5) years. One point to focus on is to carry out procedures for extending the discharge permit at the time of more than 3 months before the expiration date in the license. In case the discharge flow or discharge works have changed compared to the granted license, the project owner must carry out the procedure for applying for a new license or if not using the license, it is necessary to carry out the procedure of returning the license enclosed with a written explanation of the reason to the licensing authority.

- Enterprises and organizations granted discharge permits need to comply with the charters set out or they will be sanctioned under Decree No. 34/2005/ND-CP and Circular No. 05/2005/TT-BTNMT.
