1. What is the origin of goods?
Vietnam's amended trade law, which came into effect on January 1, 2006, introduces the concept of origin of goods: "Origin of goods is the country or territory where all goods are produced or the final basic processing of goods in case many countries or territories are involved in the production of goods. That chemistry."

2. Benefits of origin of goods:
The origin of goods is one of the important factors, directly affecting import and export activities and is a matter of concern in national and international trade.
For State management agencies: The rules of origin are tools for implementing national trade policies to develop an appropriate management policy, it has the effect of encouraging international trade to develop but still protecting domestic production.
For exporters: Taking advantage of tariff and non-tariff incentives brought by the origin of goods will help boost exports, improve the competitiveness of goods originating from their country compared to goods originating from the country, Other territories are not entitled to preferential treatment.

3. What is the certificate of origin of goods?
It can be said that the Certificate of Origin of Goods (C/O) is the clearest evidence showing the country/ territory of origin of the goods. The latest concept of C/O is stated in Article 3 of Decree No. 19/2006/ND-CP: "Certificate of origin is a document issued by an organization belonging to the country or territory exporting goods to the superior level of relevant regulations and requirements on the origin of such goods, specifying the origin of such goods". In it,
C/O Form D is a preferential C/O granted to goods exported from one ASEAN member state to another ASEAN member state under the Agreement on Tariff Preferences With General Effect - CEPT signed on January 28, 1992 in Singapore among ASEAN member states to establish the ASEAN Free Trade Area - AFTA. Vietnam joined and signed on December 15, 1995 in Bangkok and this Agreement came into force on January 1, 1996.
C/O Form E is a preferential C/O granted to goods of ASEAN countries exported to China under the Framework Agreement on Comprehensive Economic Cooperation between the Association of Southeast Asian Nations and the People's Republic of China - ACFTA officially signed in Laos on November 29, 2004 and effective from July 1, 2005.
C/O Model AK is a preferential C/O granted to goods of ASEAN countries exported to South Korea under the Framework Agreement on Comprehensive Economic Cooperation between the Association of Southeast Asian Nations and the Government of the Republic of Korea - AKFTA officially signed in Ku-a-la 5-p.m., Malalaysia on August 24th 2006 and effective June 1, 2007.
C/O Form S is a preferential C/O granted to Vietnamese goods exported to Laos to enjoy incentives under the Agreement on Economic, Cultural and Scientific And Technical Cooperation between the Government of the Socialist Republic of Vietnam and the Government of the Lao People's Democratic Republic.
4. Distinguishing the concept of produced water and country of origin:
- In the context of globalization of economic life, within the framework of the WTO and under the influence of international labor division, products are often produced from raw materials, components ... Originating from many different countries, so to determine whether the product originated from a certain country or not, we need to consider the value content factor that the product has after the process of production and processing in that country or territory. And that's why we should distinguish between the two concepts of produced water and country of origin. A product with many parts and components produced in many countries or produced with raw materials originating from different countries but when determining the country of origin for that product we can only say that the product originated from country A or country B, not that it originated from many countries.
5. The role of the competent organization granting C/O and the inspection organization of origin of goods:
- Currently, the organizations competent to grant C/O in Vietnam are VCCI, the Management Board of industrial parks, export processing zones and regional import and export management departments under the Ministry of Industry and Trade. Particularly for some preferential C/O such as C/O form D, E, S, AK, the determination of origin for goods of non-pure origin is based on one of the factors and principles such as determining the percentage of the value, determined according to the criteria of conversion of the goods code, Regulations for specific products... Therefore, the inspection to determine the origin of goods and issue certificates of inspection of origin of goods by the inspection agencies is the basis for the competent authorities to issue C / O for export shipments.

6. Steps to carry out inspection of origin of goods:

- Collecting information and documents on goods:
Set of export documents: Invoices, Contracts, P/L, B/L (If the invoice is issued at the CIF price, it is recommended to enclose the invoice or insurance contract and the freight bill for transport charges to calculate according to the FOB export price for each unit of product);
The process of mixing raw materials, accessories / Production and assembly process;

Invoices and documents to determine the value of raw materials and accessories imported outside ASEAN (Customs Declaration, Invoice, P/L, B/L, Contract);
The C/O meets the conditions of origin of samples D, E, AK, S (For goods of combined origin and for imported raw materials and accessories belonging to member countries of ASEAN, China, Korea, Laos);
Invoices, documents proving the original price, accessories do not determine the origin.
For goods imported from ASEAN member countries, ASEAN+, in order to enjoy tariff preferences under signed trade agreements, Vietnamese importers need to request exporters to provide certificates of origin of goods in accordance with the appropriate form in the host country.
